General Provisions

1.1. This User Agreement (hereinafter referred to as the Agreement) governs the legal relationship between the administration (BankOnlineUSA, LLC, hereinafter referred to as the Administration) of the portal https://bankonlineusa.com/ (hereinafter referred to as the Portal and/or Site) and an individual (hereinafter referred to as the User) when using forums, blogs, chat rooms, comments, and other interactive resources, as well as posting text messages, videos, audio, graphic materials (hereinafter referred to as Materials) on the Site, and also sending mail messages using Mail services (email).

A User is considered to be an individual who has registered on the site and uses the services and/or internet products of the portal https://bankonlineusa.com/. The text of this Agreement is presented to the User during registration. The Agreement takes effect from the moment the User agrees to its terms by registering on the Site. The User can use the services and functions of the Site only after registration.

1.2. This Agreement may be amended by the Administration without any special notice to the User. The new edition of the Agreement takes effect from the moment it is posted on the portal.

1.3. The legal relationship that arises between the User and the Administration in connection with the execution of this Agreement is governed by U.S. law.

Interaction

2.1. The Site provides Users with internet services (forums, blogs, chats, commenting function, and other interactive resources, hereinafter collectively referred to as the Service), the ability to post their Materials, and use email services for free.

2.2. To use the email functions and Services of the Portal, the User must complete the following registration procedure:

2.2.1. Fill out the registration form; 2.2.2. Agree to the terms of this Agreement. The Administration does not verify the accuracy of the information provided by the User and is not responsible to any third parties for the accuracy and truthfulness of such information; 2.2.3. Upon completing the registration process, the User enters the account login and password to access email and Portal Services. The User is personally responsible for the security of their login and password and bears full responsibility for all actions performed using their email and Portal services; 2.2.4. The User agrees that the Administration has the right to collect and store the User’s registration data within the Service to fulfill the provisions of this Agreement.

2.3. The Site’s email service is not responsible for the suitability of the Service to the User’s goals, nor for delays, deletions, or non-delivery of mail.

2.4. All questions regarding internet access, purchase, and configuration of appropriate equipment and software are resolved by the User independently and are not covered by this Agreement.

2.5. The User’s email password and Portal services can be restored by the Administration only in the case of accurate, correct, and complete input of the information specified during the initial registration by the User.

2.6. The Administration does not control or bear responsibility for the content of User correspondence, except in cases provided by U.S. law.

2.7. Posting Materials and using Services are post-moderated, meaning the moderator reviews materials after they are posted by the User on the Site. If any material violates the site’s rules and/or contains information that contradicts current legislation, such material is subject to removal.

Services (Posting Materials)

3.1. The User posts their Materials on the Site and grants the Administration the exclusive right to provide broad access to the Materials within this resource without any remuneration.

3.2. The User understands and agrees that email may contain service messages from the Administration, automatic notifications, and newsletters, which are a necessary condition for its use.

3.3. The User agrees that the Administration has the right to place advertisements and announcements on pages containing the User’s Materials, modify Materials to place ads.

3.4. Responsibility for unauthorized copying and use of Materials lies with any legal and physical persons who wrongfully used the Materials posted on the Site.

3.5. Unless otherwise specified, all property and personal non-property rights to the Material belong to the User who posted it. The User is warned about the liability established by current U.S. law for the unlawful use and posting of third-party materials (works). If it is established that the User who posted the Materials is not their rightful owner, these Materials will be removed from public access at the first request of the rightful owner.

3.6. When posting Material, the Administration indicates the User’s pseudonym (nickname) provided by the User when submitting the Material.

3.7. The Materials posted on the Site must not contain:

  • Illegal, harmful, threatening materials that insult morality, honor, and dignity, rights, and legally protected interests of third parties, defamatory, infringing copyright, promoting hatred and/or discrimination, inciting religious, racial, or ethnic strife, scenes of violence, or inhumane treatment of animals, etc., as established by U.S. law;
  • Restrictions on minority rights;
  • Impersonation of another person or representative of an organization and/or community without sufficient rights, including as employees and owners of the Administration, and misleading about the properties and characteristics of any subjects or objects;
  • Materials that the User does not have the right to make available by law or under contractual relationships;
  • Materials that infringe on any patent, trademark, commercial secret, copyright, or other proprietary and/or third-party rights;
  • Uploading, posting, or transmitting unsolicited advertising, spam, chain letters, pyramid schemes, or imposing services in any way;
  • Materials containing computer codes designed to disrupt, destroy, or limit the functionality of any computer or telecommunications equipment or programs, unauthorized access, as well as serial numbers to commercial software products, logins, passwords, and other means to obtain unauthorized access to paid resources on the Internet;
  • Deliberate and/or accidental violation of applicable local, state, or international laws;
  • Collection and storage of personal data of other users;
  • Unauthorized transmission of records of an advertising, commercial, or campaigning nature;
  • Advertising of narcotic substances;
  • Records containing crude and offensive expressions and proposals;
  • Records containing pornographic materials. It is forbidden to have more than one account (clone) if the site rules are violated or rating manipulation occurs. In case of violation of the agreement, the account will be banned (deleted) without any warning.

3.8. The User understands and accepts that they are responsible for all information, data, text, programs, music, sounds, photos, graphics, video, messages, and other materials they make available publicly or privately.

3.9. The User may not upload, transmit, or publish Materials if they were not created personally by the User or if the User does not have permission from the rightful owner to post them.

3.10. In case of claims from third parties related to the posting of materials by the User, the User independently and at their own expense resolves these claims.

3.11. The User is fully responsible for the content of their mail messages sent via the Site’s email service.

3.12. The mass mailing of commercial, political, and other advertisements or any other type of messages (information) to persons who have not expressed a desire to receive them (spam) is prohibited via the email service of https://bankonlineusa.com/.

Account Termination and User Materials Deletion

4.1. The User agrees that the Administration reserves the right to terminate the User’s account and/or block the User’s access to the Site at any time without prior notice and without specifying reasons, in the following cases:

  • Violation of the provisions of this Agreement, its parts, and amendments;
  • Upon request from government authorities in accordance with current legislation;
  • Prolonged non-use (6 consecutive calendar months) of the account for site access;
  • Other cases where the Administration deems such removal necessary for the normal operation of the Site.

4.2. The User may request the Administration to deactivate their account on the Site. Deactivation means temporarily blocking the User’s account while preserving it (without deleting the User’s information from the Site’s database). To deactivate the account, the User must send a request to the Site’s support service from the email address used for account registration, requesting account deactivation.

4.3. To restore registration on the Site (account activation), the User must send a request to the Site’s support service from the email address used for account registration, requesting account activation.

4.4. The Administration reserves the right to modify or delete any published information, including personal messages and comments, without notice, and without being liable for any damage that may be caused to the User by such actions.

4.5. In case of posting Materials that do not belong to the User, and upon receipt of a motivated complaint from the rights holder about the violation of their rights, the Administration has the right to remove the content posted by the User or block access to it without notifying the User and without explaining the reasons.

Rights and Responsibilities

5.1. The Administration strives to ensure the uninterrupted operation of the Site but is not responsible for the complete or partial loss of Materials posted by the User, as well as for insufficient quality or speed of service provision.

5.2. The User has the right to post intellectual property objects on the Site, the right to use which belongs to them on legal grounds.

5.3. The Administration has the right to refuse the User to post Materials, text messages, as well as remove Materials at its discretion if their content contradicts the requirements of this Agreement.

5.4. The User agrees that they bear full responsibility for the content of their mail messages, as well as for the Materials posted by them on the Portal. The Administration is not responsible for the content of the Materials and their compliance with the requirements of the law, for copyright infringement, unauthorized use of trademarks, company names, and logos, as well as for possible violations of third-party rights in connection with the posting of Materials on the Site. In case of claims from third parties related to the posting of Materials, the User independently and at their own expense resolves these claims.

5.5. The User grants the Administration a non-exclusive license to use, including reproduction, distribution, processing, public display on https://bankonlineusa.com/ and making public the materials posted by the User within the portal for public viewing as Site content. The User, being the lawful author of the materials mentioned in this clause, retains all property and personal non-property copyright in accordance with U.S. law and international agreements.

5.6. The User agrees not to reproduce, duplicate, copy, sell, or resell, as well as not to use for any commercial purposes any intellectual property objects posted on the Site, except in cases where such a right is granted by its rightful owner.

5.7. The Administration does not guarantee that the Site’s services will meet the User’s requirements; will be provided continuously, quickly, reliably, and without errors, and the results that can be obtained by the User will be accurate and reliable.

5.8. Any materials obtained by the User using the Site’s services are used by the User at their own risk. The User is independently responsible for any damage that may be caused to their computer and/or data as a result of downloading and using these materials.

5.9. The Administration undertakes to notify the User of claims from third parties regarding the Materials posted by the User. The User undertakes to either provide the Administration with the rights to publish the Material or remove the Material.

5.10. The Administration has the right, at the first request of the appropriate authorized (law enforcement) body, but in accordance with current legislation, to provide such a state body with any available information about the User, including personal data.

5.11. The User acknowledges that the Administration may establish restrictions on the use of services and email, including the storage period of email messages and any other materials posted by the User, the maximum number of messages that can be sent or received by one User, the maximum size of an email message or disk space.

5.12. If an individual is found performing actions that qualify as spam on the Portal’s email, the Administration has the right to block the receipt of email messages from the specified individual’s email address (including Users) to the Site’s email addresses. Additionally, the Administration has the right to contact law enforcement authorities with a request to prosecute for such actions.

5.13. The Administration is not responsible:

  • For the User’s actions on the Site;
  • For failures in telecommunications and/or power networks, the action of malicious programs, as well as for unscrupulous actions of third parties;
  • For the content and legality of the Information used/received by the User within the Service, as well as for its nature;
  • For damage/lost profits caused to the User as a result of using or not being able to use a particular service;
  • For the reliability of advertising information received by the User within the service, and the quality of advertised goods/services, etc.;
  • For certain damage to the User’s software and/or hardware complex that arose as a result of using the service.

General Information

6.1. This Agreement is legally binding for both the Administration and the User.

6.2. The User has the right to refuse to accept changes and additions to the Agreement made by the Administration, which means the User’s refusal from the Site’s services.

6.3. All possible disputes arising in connection with the execution of this Agreement are resolved in accordance with the norms of current U.S. legislation.

6.4. Nothing in the Agreement can be understood as establishing between the User and the Administration agency relationships, partnership relationships, joint activity relationships, personal hiring relationships, or any other legal relationships not directly provided for in this Agreement.

6.5. A User who believes that their rights and interests have been violated due to the actions of the Administration or third parties in connection with the posting of any Material on the Site, sends a claim to the support service. The material will be immediately removed from public access at the first request of the rightful owner.

6.6. In the event of the adoption of regulatory acts by the authorities of the United States that fully or partially affect the functioning of the Site or Services, the Administration reserves the right to make any changes to the functioning of the Services aimed at bringing the Site’s activities into compliance with the new norms.
